Acceptance of Terms

By using any of the Abundant Life Ministries (ALM) websites, domains, or email address (including, but not limited to the following: TheHerbDoc.com, TheHerbDoc.org, TheHerbDoc.net, FamilyBible.org, or any of our email addresses, blogs, forums, or any other electronic presence on either public or private domains) in any way (including any email or instant messages) (“The Domain”) you are agreeing to comply with these terms, which we may update without notice. You are encouraged to review these Terms of Use upon every visit to the Domain. To use these facilities, you must be legally competent to enter a binding agreement.

Your access to, and use of, this group of web sites (the “Sites”) is conditioned on acceptance of the terms and conditions set forth herein. Read these terms before using the Sites. By accessing, using, viewing, browsing, etc. the Sites, or by sending email or instant message to any address in any of these domains, you agree to these terms. If you do not agree to these terms, do not access the Sites in any way.

This computer system is private property, and any unauthorized use is prohibited by law. Operation of a spider or any other software, hardware, and/or scripts for the purpose of collecting and/or harvesting email addresses or our visitors’ personal information is strictly forbidden. Violators may be subject to a fine of up to Five Hundred Dollars U.S. (US$500.00)  for each file request made for these purposes.

Trademarks

TheHerbDoc™ caricature of Dr. Sawyer, the stylized naturopathic caduceus, and the term “The Herb Doc” in any of their forms are the copyrighted Trademarks of Abundant Life Herb Shop. All other brands and names are property of their respective owners.

Materials

The materials (including but not limited to the text, information, data, images, audio, video, computer programs and/or anything else found at the Sites) (the “Materials”) on the Sites are provided by ALM as a service to the public, our distributors, and our customers, and may be used for informational purposes only. Single copies may be downloaded subject to the provisions below.

Single Copy License

The Materials at the Sites are copyrighted and any unauthorized use of any of the Materials at the Sites may violate copyright, trademark, and other laws. You may not copy, reproduce, modify, publish, upload, post, transmit, or distribute in any way the Materials except that you may download one copy of the Materials to a single computer for your personal, non-commercial internal use only unless specifically licensed to do otherwise by ALM in writing or as allowed by any license terms which accompany or are provided with individual pieces of information and/or works of authorship.

Termination Of This License

ALM may terminate this license at any time. Upon termination, you will immediately destroy the Materials.

IN NO EVENT SHALL ALM OR ITS OFFICERS, EMPLOYEES, SUPPLIERS, OR AGENTS BE LIABLE FOR ANY DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, BUSINESS INTERRUPTION, LOSS OF INFORMATION) ARISING OUT OF THE USE OF OR INABILITY TO USE THE MATERIALS, EVEN IF ALM HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. ALM does not warrant the accuracy or completeness of the information, text, graphics, links or other items contained within the Materials. ALM may make changes to these Materials, or to the products described therein, at any time without notice. Submissions

ALM may, but is not obligated to, monitor or review any areas either on or related to the Sites where users transmit or post Communications or communicate solely with each other, including but not limited to chat rooms, bulletin boards, eGroups, or other user forums, and the content of any such Communications. ALM, however, will have no liability related to the content of any such Communications, whether or not arising under the laws of copyright, libel, privacy, obscenity, or otherwise.

Links To Other Web Sites

Any linked sites are not under the control of ALM and ALM is not responsible for the content of any linked site or any link contained in a linked site. ALM reserves the right to terminate any link or linking program at any time. ALM does not endorse companies or products to which it links and reserves the right to note as such on its web pages. If you decide to access any of the third party sites linked to the Sites, you do this entirely at your own risk.

Presence of email addresses on this site does not invite unsolicited commercial email (UCE or SPAM), which constitutes a Federal Crime of theft of our computing resources. All information in any unsolicited commercial email or instant messages that are sent to any of our email addresses or instant messaging IDs permanently and irrevocably becomes the property of ALM.

By accessing this website in any way, or by sending email or instant messages to any address at any of our domains, you agree to be bound by these Terms and Conditions.

Applicable Laws

The Sites are controlled by ALM from its offices within the state of West Virginia in the United States of America. ALM makes no representation that Materials in the Sites are appropriate or available for use in other locations, and access to them from territories where their content is illegal is prohibited. Those who choose to access the Sites from other locations do so on their own initiative and are responsible for compliance with applicable local laws. You may not use or export the Materials in violation of U.S. export laws and regulations. Any claim relating to the Materials shall be governed by the internal substantive laws of the State of West Virginia. Sole and exclusive jurisdiction for any action or proceeding arising out of or related to this agreement shall be an appropriate state or federal court located in the state of West Virginia.

Our websites operate on computer systems that are located in West Virginia and New York, and are therefore subject to the laws of those two states.

West Virginia Code 46A-6G imposes “Limitations on unauthorized electronic mail: ... No person may initiate the transmission of an unauthorized electronic mail message … or a bulk electronic mail message from a computer located in the state of West Virginia or to an electronic mail address that the sender knows, or has reason to know, is held by a West Virginia resident … a minimum damage assessment of one thousand dollars may be recovered for violations of this article.
